As the new academic year approaches, schools must prepare to implement changes aligned with new Title IX rules.
The updated federal regulations – which explicitly protect LGBTQ+ students from discrimination based on gender identity and sexual orientation – come at a time when a surge of anti-LGBTQ+ legislation is underway. This year, legislators introduced 206 anti-LGBTQ+ bills restricting student and educator rights in states across the nation, according to the American Civil Liberties Union’s tracker.
The Biden administration has received criticism for and opposition to its Title IX overhaul.
Progressives decry the omission of clearcut protections for transgender student athletes, especially given the ongoing student mental health crisis that disproportionately affects LGBTQ+ youth. Meanwhile, the majority Republican U.S. House of Representatives passed a partisan resolution in July to nullify the final rule.
Not to mention, pending litigation complicates how schools can roll out new and revised Title IX policies and processes. Across 26 states, a slew of legal challenges temporarily blocked the rule from taking effect.
