The updated Title IX rules – which explicitly protect LGBTQ+ students from discrimination based on gender identity and sexual orientation – arrived amid a surge of anti-LGBTQ+ legislation.

In 2024, legislators introduced 206 anti-LGBTQ+ bills restricting student and educator rights in states across the nation, according to the American Civil Liberties Union’s tracker.

Not to mention, pending litigation complicates how schools can roll out new and revised Title IX policies and processes. Across 26 states, a slew of legal challenges temporarily blocked the rule from taking effect.
